Warranty
- TAS Sealing Bushings, LLC (TAS) warrants that: TAS will transfer title to the Goods to Customer under Clause 4 of the Terms of Sale; (a) will conform with the Specifications; (b) Goods made by TAS or its Affiliates, under normal use and care, be free from defects in material or workmanship; and (c) TAS and its Affiliates’ are trained and use reasonable skills and care.
- WARRANTY PERIOD. Unless otherwise specified herein, the warranties in Clause 1 above apply as follows: (a) Goods: until the earlier of twelve (12) months from first installation or eighteen (18) months from shipment. (b) Goods repaired or replacement items: from shipment of the replacement or completion of the repair, for ninety (90) days or until the end of the original warrantee (if later).
- Warranty Procedure. This Clause applies if, within the warrantee period, Customer discovers any non-conformity with a warranty in Clause 1, tells TAS in writing and returns non-conforming goods at Customer’s cost, freight and insurance pre-paid, to the repair facility chosen by TAS. Where this Clause applies, TAS will, at its sole option, either: (a) correct any non-conforming issue by repairing or replacing non-conforming goods with the latest version at the repair facility, or (b) refund the price of the non-conforming item.
- EXCLUSIONS FROM WARRANTY. (a) the warranties in Clause 1(b) and (c) exclude and Customer will pay the cost of all repairs and replacements caused by any of the following: normal wear and usage; inadequate maintenance; unsuitable environmental conditions; improper handling, storage, installation, or operation; misuse or accident caused by anybody except TAS; modification or repair not approved by TAS in writing; materials or workmanship made, provided or specified by Customer; contamination; the use of unapproved parts; Cyber Attack; any other cause not the fault of TAS. (b) TAS will not pay any costs relating to non-compliance with any Federal, State, or local laws or regulation. TAS warranty in Clause 1 will not make exception unless agreed in writing in advance. Unless accepted in writing by TAS, in advance, Customer will pay: (i) all cost of dismantling, freight reinstallation and the time and expenses of TAS Personnel for travel under this Clause; and (ii) all costs incurred by TAS in correcting nonconformities for which TAS is not responsible under this Clause and in examining items that comply with warranties in Clause 1.
- OTHER. If TAS relies on wrong or incomplete information supplies by Customer, all warranties are void unless TAS agrees otherwise in writing. Customer alone is responsible for the selection, application, maintenance and use of goods. Resale products carry only warranty given by the original manufacturer and TAS has no liability for Resale Products beyond a reasonable commercial effort to arrange procurement and shipping of the resale Products.
- DISCLAIMER. The limited warranties set out herein are the only warranties made by TAS and can be changes only with TAS’s signed written agreement. THE WARRANTIES AND REMEDIES IN THIS CLAUSE ARE EXCLUSIVE. THERE ARE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, ABOUT MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE OR ANYTHING ELSE FOR ANY OF THE GOODS, DOCUMENTATION OR SERVICES.
